General terms of agreement in SENECA INTENSIV


1. Registration


1.1 Registration for a seminar, audition or introductory day


  • Registration for individual seminars, auditions and admission procedures as well as introductory days via our online form on our website senecaintensiv.de is a binding registration. Once you have submitted your registration, SENECA INTENSIV considers it to be legally binding. 
  • Once we have received your registration, we will send you a written confirmation by e-mail; only then will you be entitled to participate. 
  • After registration via the online form and confirmation by SENECA INTENSIV, an invoice will be sent by e-mail. The registration process is completed with the transfer of the participation fee. 
  • The number of participants in all our seminars is limited. Seminar places are allocated in the order in which registrations are received.
  • The realization of the seminars is dependent on reaching the respective minimum number of participants. Fees already paid will be refunded if the seminar is canceled by SENECA INTENSIV.


1.2 Registration and contract signing for an educational program


  • Registration for one of our educational programs is only possible after suitability has been checked.
  • A contract is concluded after counseling or after the admission procedure has been completed and passed.
  • The contract is concluded by signing a participation contract provided by SENECA INTENSIV. The signed participation contract must be submitted to SENECA INTENSIV by post, e-mail or in person.
  • Once the contract has been signed by both parties, a claim to participation arises and the registration process is complete. 
  • The number of participants is limited for all of our educational programs. Places are allocated in the order in which the contracts are received.
  • The implementation of the educational programs is dependent on reaching the respective minimum number of participants. Fees already paid will be refunded if the seminar is canceled by SENECA INTENSIV.


2. Participation fees


  • The participation fees are generally shown on our website and in our information material and apply upon registration. All prices quoted are final prices. Due to § 4 No. 21 a) bb) UStG we do not charge VAT and therefore do not show it. The tax number at the Berlin tax office is: 27/612/05131 
  • As a rule, the participation fees are to be transferred in one sum to the specified account 14 days after invoicing. 
  • SENECA INTENSIV expressly reserves the right not to admit participants to the course/not to admit them to the examination/not to issue the certificate if payment is not made in full.
  • A state-regulated subsidy with education bonus, education check or Quali check or similar is possible if the corresponding notification of the participant is received by SENECA INTENSIV before the start of the training.


3. Transfer, cancellation, withdrawal


3.1 Transfer for a seminar


  • In the case of a seminar, you can nominate another person to attend in place of the registered participant at any time, provided that this person fulfills the participation requirements. You will not incur any additional costs as a result. 


3.2 Cancellation


  • Online registration can be canceled by post or e-mail.
  • You can cancel your online registration for an audition or an introductory day at any time free of charge, i.e. you will be completely exempt from paying the participation fees. Only the processing fees confirmed during online registration will be charged by SENECA INTENSIV after the 14-day right of withdrawal has expired. 
  • If the online registration for a seminar is canceled up to four weeks before the start of the seminar, only the processing fees confirmed at the time of online registration are payable. If the online registration for a seminar is canceled within two to four weeks before the start of the seminar, 50% of the participation fee and the processing fees confirmed at the time of online registration must be paid. Cancellation within two weeks before the start of the seminar or failure to attend the seminar will result in the full participation fee being due. 
  • The date of receipt by SENECA INTENSIV of the written cancellation by e-mail or post shall be decisive for compliance with the deadlines. 
  • Irrespective of these regulations, the 14-day right of withdrawal applies to the online procedure. You have the right to cancel the online registration within fourteen days without giving reasons. The withdrawal period is fourteen days from the date of registration. In order to exercise your right of revocation, you must inform us of your decision to revoke this registration by means of a clear declaration. This must be done in writing by e-mail or by post.


3.3 Withdrawal from a subsidized measure


  • If the Jobcenter/employment agency does not or no longer grants funding for a funded measure, both the funded participant and SENECA INTENSIV are entitled to withdraw from the contract. The participant shall not incur any costs as a result of the withdrawal. SENECA INTENSIV must be provided with evidence of the rejection or discontinuation of funding by the funding institution.


4. Termination 


  • All educational programs lasting several months can be terminated by the participant with a notice period specified in the participation contract of the educational program.
  • SENECA INTENSIV is entitled to terminate the contract without notice with immediate effect if the participant has not paid the participation fee on time.
  • The mutual right to extraordinary termination without notice for good cause remains unaffected. Important reasons are in particular Frequent lateness and absence of the participant for reasons attributable to him/her; willful damage to or destruction of facilities and equipment at the seminar venue; repeated disregard of instructions; misrepresentation or concealment of important facts in order to participate in an offer; inadequate performance by the participant despite warnings; harassment, use of violence or threats thereof towards SENECA INTENSIV staff or other participants; drug and alcohol consumption within the seminar venue.
  • Notice of termination must always be given in writing by e-mail or by post.
  • In the event of extraordinary termination by SENECA INTENSIV for good cause, the participant must be given a warning in advance, together with a reasonable period of time to remedy the breach of duty. There is no right to reimbursement of participation fees already paid or waiver of outstanding participation fees.


5 Cancellation and reservation of changes


  • SENECA INTENSIV as the organizer reserves the right to cancel or postpone the offer at short notice, despite confirmation of registration, if the specified minimum number of participants has not been reached on the scheduled date, the lecturer falls ill at short notice or force majeure (including, but not limited to, the following examples: War, earthquake, pandemic, epidemic, lightning strike). In this case, SENECA INTENSIV will inform the participants immediately. In the event of cancellation without substitution, participation fees already paid will of course be refunded. There is no entitlement to a new start date or other compensation. Further claims (travel costs, telephone costs etc.) cannot be asserted against SENECA INTENSIV. 
  • Seneca intensive is entitled to make necessary changes to the content, methodology and organization or deviations (e.g. due to legal changes) before or during the offer if the goal for the participant is not significantly impaired. 
  • Seneca intensiv is entitled to replace the scheduled lecturers with other equally qualified lecturers if necessary (e.g. illness, accident). 


6. Liability


  • SENECA INTENSIV accepts no liability for accidents and damage on the way to and from the course location. Note: It is recommended that you have accident insurance. Participation in individual seminars and short-term seminar series is at the participant's own risk.
  • SENECA INTENSIV also accepts no liability for loss, damage or theft of items of any kind. Please take care of your valuables in the rooms. 
  • The participant must report any personal injury or damage to property to SENECA INTENSIVE immediately in writing, stating the circumstances.Any misuse of the teaching materials provided by SENECA INTENSIV can lead to claims for damages on the part of Seneca Intensiv or third parties. 


7. Place of fulfillment, place of jurisdiction, out-of-court online dispute resolution


  • The place of jurisdiction for all disputes arising from or in connection with the concluded contract is Berlin. 
  • Under the link http://ec.europa.eu/consumers/odr/ the European Commission provides a platform for out-of-court online dispute resolution in accordance with Art. 14 (1) of EU Regulation No. 524/2013. This platform offers consumers/participants the opportunity to resolve disputes in connection with their online booking/online order initially without the involvement of a court. 8. Data protection and data storage
